Run180 provides you with access to a variety of resources, including download areas, communication forums and product information (collectively “Services”). The Services, including any updates, enhancements, new features, and/or the addition of any new Web properties, are subject to these Terms & Conditions.

The Services are for your personal use only. You must obtain Run180’s written consent to use the Services for any other use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services. You must not copy or retransmit any logo, graphic, sound or image from the Run180 website without Run180’s written consent. Dreamwild Pty Ltd and Run180 is not liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of software, documents, provision of or failure to provide Services, or information available from the Services. Dreamwild Pty Ltd and Run180 does not warrant that: your systems will meet the minimum requirements to enable use of the website; information provided on the website is accurate, complete or suitable for any purpose; the website and Services are free from any computer viruses or defects; or your access to the website and Services will be continuous or uninterrupted.

Liability

The total liability of Dreamwild Pty Ltd and Run180 is as follows: a. The replacement or repair of the goods or the payment of the cost of replacing the goods, as nominated by Run180; b. The supply of the Services again or the payment of the cost of having the Services supplied again as nominated by Run180. Dreamwild Pty Ltd and/or Run180 are not liable for: a. the death of any person; or b. the physical or mental injury to any person (including the aggravation, acceleration or recurrence of physical or mental injury); except to the extent caused by the reckless conduct of except to the extent it constitutes significant personal injury caused by our reckless conduct. Dreamwild Pty Ltd and/or Run180 are not liable for: a. any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use or performance of software, documents, provision of or failure to provide Services, or information available from the Services; and b. Dreamwild Pty Ltd and/or Run180’s total liability to you, whether in contract, tort, statute or otherwise, or in any manner related to the terms of use or the website is limited in the aggregate to the total amount of licence fees paid by the you in the month immediately preceding the claim.

Your Account

You are entirely responsible for maintaining the confidentiality of your password and account and for all activities that occur under your account, in relation to the Services. You must notify Run180 immediately of any unauthorised use of your account or any other breach of security. Dreamwild Pty Ltd and/or Run180 are not liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. You must keep your username and password confidential and secure and not to permit any other person to access the Services using your username and password. You agree that your details are non-transferrable.

Feedback

When you post, upload, input, provide or submit any feedback, suggestions or comments (“Comments”) you grant Dreamwild Pty Ltd and/or Run180 permission to use your Comments in connection with the operation of their business including, without limitation, the license rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Comments and to publish your name in connection with your Comments. Run180 is under no obligation to post or use any Comments you may provide and Run180 may remove any Comments at any time in its sole discretion. You will not be paid or compensated for the use of your Comments. You warrant and represent that you own or otherwise control all of the rights to your Comments. If your Comments contain images, photographs, pictures or graphics (“Pictures”), you warrant and represent that: a. you are the copyright owner of the Pictures, or that the copyright owner of the Pictures has granted you permission to use the Pictures or any content and/or images contained in the Pictures consistent with the manner and purpose of your use and permitted by these Terms and Conditions; b. you have the rights necessary to grant the licenses and sublicenses described in these Terms and Conditions; c. that each person depicted in the Pictures, if any, has provided consent to the use of the Pictures as set forth in these Terms and Conditions, including, by way of example, and not as a limitation, the distribution, public display and reproduction of the Pictures. By posting the Pictures, you are granting: a. to all members of your private community (for each the Pictures available to members of such private community), and/or b. to the general public (for each the Pictures available anywhere on the Services, other than a private community), permission to use the Pictures in connection with the use, as permitted by these Terms and Conditions, of any of the Services, (including, by way of example, and not as a limitation, making prints and gift items which include the Pictures), and including, without limitation, a non-exclusive, world-wide, royalty-free license to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Images without having your name attached to the Pictures, and the right to sublicense such rights to any supplier of the Services. The licenses granted in the preceding sentences for any Pictures will terminate at the time you completely remove the Pictures from the Services, provided that, such termination shall not affect any licenses granted in connection with the Pictures prior to the time you completely remove such Images. You will not be paid any compensation for the use of your Pictures.

NSW Law

Dreamwild Pty Ltd and/or Run180 are bound by the Privacy Act 1988 (Cth) (as amended) (“Privacy Act”), including the Australian Privacy Principles. The Run180 Privacy Policy is on our website: https://run180.com.au/.

Dreamwild Pty Ltd and/or Run180 may collect personal information in order to conduct its business, to provide and market its services and to meet its legal obligations.

When you use Run180’s website or services, or by providing any personal information to Run180, you consent to the collection, use and disclosure of your personal information as set out in the Run180 Privacy Policy.

Run 180 may collect and hold personal information about clients, business associates and potential clients and their employees; suppliers and their employees; and prospective employees and contractors.

Run 180 may collect may also collect and hold your name, address, contact telephone number and other contact details such as your email address; payment information (such as credit card or bank details) and details of your use of our products or services.

You do not have to provide personal information to Run180 but if you don’t provide Run180 may not be able to supply the product or service that you have requested from Run180

Run 180 may make use of a number of automated processes using your Personal Information and your activity Run180’s site as tracked by Run180, in order to provide more tailored and relevant services to you.

Cookies

Run180’s website have pages that use ‘cookies’. A cookie is a unique identification number that allows the server to identify and interact more effectively with your computer. The cookie assists Run180 in identifying what users find interesting on Run180’s website.

A cookie will be allocated each time you use Run180’s website. The cookie does not identify you as an individual in Run180’s data collection process, but it does identify your Internet Service Provider.

Third Party Service Providers

Run180 may disclose your personal information to third party service providers who assist Run180 in providing the services and to promote, market or improve the services that Run180.

Run180 has contracts with third-party service providers that only allows use and disclosure of personal information to provide the service and that protects your personal information in accordance with the Privacy Act.

Disclosure of personal information to overseas recipients

Run180 does not disclose personal information to any organisations located overseas however, Run180 discloses information in Australia, for the purposes described above, to some multinational organisations that are located both in Australia and overseas, including the United Kingdom, the United States and New Zealand.

Collection of Data

Dreamwild Pty Ltd and Run180 collects and stores all personal information related to your app profile, which you voluntarily give us either upon sign-up or through the continued use of the app.  This data may include name and email address.

Deletion of DataData

Dreamwild Pty Ltd and Run180 shall delete your confidential data, in a secure manner that prevents its physical reconstruction within ninety (30) days following termination or expiration of this Agreement, or a request by you.  To request such an action, you may email rachel@run180.com.au

European Union – General Data Protection Regulation (GDPR)

If you are a resident of the European Union for the purposes of the GDPR, then in addition to Run180’s Privacy Policy, you must be informed of the following:

Run180 is a data controller and processor for the purposes of the GDPR and by your consenting to the Run180 Privacy Policy, Run180 is able to process your personal information in accordance with this Privacy Policy.
